			<content:encoded><![CDATA[<p>Bank of America has announced that they will be cutting 30,000 jobs or 10% of its work force. This means that there will be fewer employees to handle all aspects of their business. I have been unlucky enough to have had to deal with BOA many times and while I have had a surprise here and there for the most part they are the slowest and worst bank to deal with when it comes to short sales. We had a meeting once where our entire office was invited to a seminar hosted by BOA and when the speaker who happened to be a negotiator had a Q&amp;A with us, I asked why they denied a short sale only to sell it as a foreclosure for a lot less. The speaker answered my question with a question which was &#8220;Was the seller an investor&#8221; I replied yes. She then said that they don&#8217;t accept short sales from investors who make bad decisions only from owner occupied sellers. I then replied that by punishing my seller/ investor they also punished their investors/stock owners who could have received a higher amount for that property. The speaker did not know what to say so she ignored my comment and moved on to the next question. I think BOA is in this situation because they make bad decisions. To attempt to punish an investor by not allowing a short sale only to sell it for less is basically cutting off your nose to spite your face. Now we hear that they are slashing 30,000 jobs because their investors have lost confidence, hmm I wonder why. Now a bank that is known for bad service in the short sale department will surely get worst and it may affect their costumer service in all fields not just the short sales.</p>

			<content:encoded><![CDATA[<p>A new survey recently published by New York City-based Luxury Institute and the Institute for Luxury Home Marketing show statistics that prove the affluent are taking advantage of the lower home prices and moving up to bigger, more extravagant homes. One in four U.S. consumers has bought a larger more luxurious home since 2008 and 23% of those are under the age of 50 and plan on trading up in homes in 2011. These statistics apply to those earning more than $150,000 per year but anyone can take advantage of this market. I tell my clients that as long as they are buying another home in the same area that is equal or more expensive they will not lose any money as the money lost on the sale is recovered on the purchase of their new home, in fact, if the new home they buy is more luxurious then they are actually saving more than what they lost. I have seen this trend myself with clients here in the Pinellas County area as they are buying homes directly on the beach instead of across the street on the bay since now they can afford that luxury of being directly on the sand! They are picking up bargains because, as we all know, the affluent did not get wealthy by throwing their money away. 			<content:encoded><![CDATA[<p>My pregnant wife recently had an urge for some Wedding soup and we were in the Clearwater area so as we Googled for restaurants through our phones we found Farmer Boy restaurant at 2129 Drew St. In Clearwater FL. when we walked inside we were immediately greeted by a lady who was very courteous and showed us to our seats. As we looked through the menu my wife found the Wedding soup she was craving for and I was more than happy to try the gyro. Well the soup according to Krystin (my wife) was fantastic and I can safely say the gyro was one of the best I have ever had. 			<content:encoded><![CDATA[<p>I just recently discovered a little piece of paradise&#8230;. I knew it was there but had never visited. You see I just recently bought a boat and for Fathers day, my pregnant wife, her brother, her mother and Father and my self went out on the water with our boats (Her father has one as well). Anyway, this 3 Rooker sand bar is a small island about 3 miles out from Crystal Beach, in Palm Harbor Florida. This small island is frequented by many locals and is an apparent hot spot in the area. We enjoyed our fathers day picnic on the Island and fished unsuccessfully off our small fishing boats. The Island is close enough that you can kayak over from the Dunedin causeway and is mostly white sand beach with the exception of a bird sanctuary. I also stopped by several of the smaller Islands in the area and found a really nice one just south of the Dunedin Causeway which had trees and offered some small trails although the beach on it was no where as nice as 3 Rooker Island. I wonder if there is any surf at times on 3 Rooker Island on the Gulf side enough to use my longboard? Well if you have visited this small piece of paradise or know of others, I would love to hear from you!</p>

			<content:encoded><![CDATA[<p>Well, what can I say&#8230;. Short Sales are a big part of my business and while I wish every sale were a regular non-distressed sale, those days are gone for a while. I am writing this because recently, I have had a few short sales go sour because of what appears to be a need to punish the homeowner for making a bad investment. It’s happened with a few bank and especially with one big bank with the initials of a large snake (Guess which bank has the initials of a large snake?) Anyway, what these banks are doing is the following&#8230;&#8230; They are asking the owners of distressed properties for large amounts in cash at closing or promissory notes (a promise to pay) in order to allow the short sale. There is one major problem with that&#8230;.. The people doing short sales have bad credit already and most of them have no money and tons of debt. I am not judging and yes maybe they should not have bought more home than they could afford. The problem is that the banks are also hurting the investors that buy the notes from them (If you did not know, most banks service/bill most of the loans but don’t actually own them). I have had a bank recently decline a short sale only to foreclose and then sell the property for a lot less as a foreclosure. They did not actually own that note but only serviced it. They could have gotten more money for their investor but instead they chose to punish the seller and not allow him to short sell. I actually went to a seminar hosted by Bank of America and the negotiators actually admitted that it is policy to not allow a short sale in order to punish a seller of non-primary residence. Another technique that they are using is telling us agents, negotiators and attorneys that the M.I (Mortgage Insurance) company is requesting a promissory note or they will block the short sale. So the question is&#8230;.Did these banks go out and buy mortgage insurance behind the property owners back and not charge them for it? Or is an excuse to block the short sale, since it’s my experience that banks don’t pay for anything without passing on to the consumer? It may be that these M.I. companies are asking for these promissory notes but they are also not telling us negotiators who that M.I. company is since they don’t want us to call that company and negotiate a smaller pay off. We negotiate payoffs with associations, 2nd loans, contractor’s liens, home owner associations&#8230;.. so why not M.I. companies? To these banks I say&#8230;. who are you to punish the investor for making a bad investment? Did we not need to bail you out for your bad investments? Something fishy is going on with these banks and there &#8220;M.I.&#8221; companies. 			<content:encoded><![CDATA[<p>One of my favorite places to eat is Ozona Blue in Ozona (Palm Harbor). I always go there for the crab cakes amongst other things like the live bands and the general ambiance. Recently I went there for some appetizers and when I ordered the crab cakes they did not taste the same. They were still good but not as good as they were before. Anyway, the manager was nice enough to take them back and he said to ask for them &#8220;The Old Way&#8221;. Sure enough he brought 2 large delicios crab cakes (especially for the money)and they were prepared just like I like them. Have you been to Ozona Blue? What is your favorite dish there? Let me know, I would love to try it.</p>

			<content:encoded><![CDATA[<p>Ok, if you know me then you probably know that I love chocolate ice cream. My favorite place to get to ice cream in the entire bay area is Strachan&#8217;s on the corner of Alt. 19 &amp; Tampa Rd. in front of the CVS. They just opened a new location at  310 Main Street Dunedin, FL. 34698 a few months ago and ummmm they are using the same recipes. Anyway stop by and have some of the best ice cream in the planet! My favorite is the Rocky Road!! You may also want to try anything that  has the YUM YUM sauce! Another one of my favorites is the brownie sundae, but make sure you have it while the brownie is still hot underneath the ice cream. Let me know what your favorites are. also let me know if you think there is worthy competition, I will be more than glad to test it out. <p>TALLAHASSEE, Fla. – June 14, 2010 – Shortly after Orlando Eslava’s bank started to push him through the foreclosure process last year, he got some good news: He was eligible for a government mortgage relief program that would lower his loan payments. But the lender plowed ahead with the foreclosure sale anyway, taking back the condo in Aventura, Fla., even as Eslava made payments under the federal plan.</p>
<p>When a Florida judge learned of the foreclosure, she threw out the case and nullified Eslava’s existing mortgage balance.</p>
<p>Eslava’s case reflects the state of confusion among lenders and courts as they struggle to keep up with a backlog of millions of delinquent homeowners making their way through the foreclosure process. Bank repossessions jumped more than 40 percent in May, to more than 90,000, compared with the same period last year, according to data released Thursday by RealtyTrac, an online service that tracks the foreclosure market.</p>
<p>That uptick is likely to continue this year, and it could take at least three years to work through the backlog of delinquent borrowers, economists say. In many cases, lenders are pushing their cases through overwhelmed courts and facing emboldened homeowners challenging the repossession of their homes on technical grounds.</p>
<p>By the time HSBC began the foreclosure process last year, Eslava, 53, had been trying to get a loan modification for more than a year. In November, a judge approved HSBC’s request to proceed with the repossession and set an April 9 sale date. But after discovering that HSBC could not produce proof that it held Eslava’s mortgage note, the judge ordered the bank to post a $414,000 bond.</p>
<p>The next day, Eslava learned that he was eligible for the federal foreclosure prevention program, which would lower his mortgage payments to $620 a month from about $1,000.</p>
<p>“It was a big relief. Like it was finally going to be over,” Eslava said.</p>
<p>The loan modification should have prevented the foreclosure. But HSBC continued to oppose efforts by Eslava’s attorney, Sheleen Khan, to cancel the foreclosure sale. “All he was looking to do was modify the loan,” Kahn said. “It was very trying for him and nerve-racking for me because we didn’t know what would happen.”</p>
<p>Eslava made several payments under the government relief program, but HSBC foreclosed on the home in April. Kahn filed a motion to overturn the sale, pointing out that in addition to ignoring the loan modification, the bank had not posted the bond required by the judge.</p>
<p>Miami-Dade Circuit Court Judge Jennifer Bailey agreed and brought both sides back to court in early May. Noting that 60,000 foreclosure filings were made in Miami-Dade County last year and that every hearing takes precious minutes, Bailey lambasted the bank’s attorneys for wasting time.</p>
<p>“It doesn’t sound like much, but [every case] represents a situation where the bank’s position is constantly shifting and changing because they don’t know what the Sam Hill is going on in their files,” Bailey said, according to a transcript of the hearing.</p>
<p>“Why did you lose the note? Because you’re operating at the same level of chaos and disorganization that caused you to oppose the motion to cancel the sale when” Eslava had been given a loan modification, Bailey said. A few minutes later, Bailey sanctioned the bank by wiping out Eslava’s mortgage debt. The mortgage note “is null and void. Mr. Eslava is relieved of the debt,” Bailey said.<br />

Eslava, who was not at the hearing, was shocked by the news. He had hoped that the foreclosure would be reversed and that he would remain in the government program. “It’s naturally a good feeling,” he said. “I did everything I was supposed to do.”</p>
<p>HSBC, which as the trustee owns the legal title to Eslava’s loan on behalf of a group of investors, said it does not comment on the specifics of legal matters.</p>
<p>Wells Fargo, which acted as the servicer on the loan, said in a statement: “We work hard to comply with all applicable legal requirements and we expect the firms we work with – in this case, Florida Default Law Group – to do the same. Although this was a technical error on their part, if we make a mistake, we fix it and we hold others we work with to the same high standards.”</p>
<p>Florida Default Law Group, which represented both banks in court, declined to comment.</p>
<p>There have been similar cases in New York and Illinois in which frustrated judges have wiped out a homeowner’s mortgage, but it is still far from a trend, said Diane E. Thompson, attorney on foreclosure issues at the National Consumer Law Center. “I don’t think that homeowners or their advocates should step into court and expect judges to do this for them, even if the lender can’t come up with the note,” Thompson said.</p>
<p>Many states are dealing with the backlog of homeowners winding their way through the process with mediation programs, requiring lenders in some cases to consider a loan modification before moving forward with a foreclosure. Maryland lawmakers approved a similar program this year. “That is a more hopeful trend, and it has the potential to resolve these disputes for everybody,” Thompson said.</p>

			<content:encoded><![CDATA[<p>This is my first blog post ever, so please be easy. Anyway, this blog is about Honeymoon Island Beach &amp; State Park. The question is&#8230;.. Is Honeymoon Island one of America&#8217;s best beaches? There is just so much to do there that I consider it one of the best. I am no Dr. Beach but I was born in Costa Rica which is known to have some of the best beaches in the world, so I know a nice beach when I see one. Caladesi Island has been voted one of the best more than once and in 2008 it was voted the #1 beach in America. In those same polls I noticed some other familiar beaches but have never seen Honeymoon Island on the list. Is it because it is considered a part of Caladesi? I think not. The water is just as clear and you don&#8217;t need a boat or a ferry to get to it like caladesi does. Don&#8217;t get me wrong, I am not bashing Caladesi Island, I just want Honeymoon to get its recognition. </p>
<p>                  I am a begginer surfer and living on the west coast of Florida is no fun for long board surfing or is it? Ok, so we don&#8217;t get 6 ft waves unless a hurricane is in the Gulf (Lets hope they don&#8217;t come this year because of the oil spill, but that will be another blog). Anyway, we actually get some fun small waves in the summer. In the winter the cold fronts make waves a little bigger. Either way, the waves that form on Honeymoons&#8217; Main Beach are extremely long and fun to surf. Besides the fun waves, we have a paradise of trails for bird watchers. I was walking through one on the trails with my girlfriend Krystin and we saw a huge Osprey carrying a fish in its tallons,it was amazing. Then we saw another one perched on a high branch which made me wish I had brought my DSLR camera with a long lens instead of my girlfriends point and shoot. Either way, I think it should get more national recognition than it does. I put together a little video to show some of the activities (I was not able to go on the trail that day since they were having a prescribed burn.)Check it out and let me know what you think.</p>
